Waiver of Liability, Assumption of Risk, and Indemnity Agreement

Waiver: In consideration of being permitted to participate in Intramural Sports, I, for myself, my heirs, personal representatives or assigns, do hereby release, waive, discharge, and covenant from any and all claims including the negligence of The Regents of the University of California, its officers, employees, and agents, resulting in personal injury, accidents, or illnesses (including death), and property loss arising from, but not limited to, participation in Intramural Sports.

Assumption of Risks: Participation in Intramural Sports carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries. The specific risks vary from one activity to another, but the risks range from 1) minor injuries, such as scratches, bruises, and sprains to 2) major injuries such as eye injury or loss of sight, joint, or back injuries, heart attacks, and concussion to 3) catastrophic injures including paralysis and death.

I have read the previous paragraphs and I know, understand, and appreciate these and other risks that are inherent in Intramural Sports. I hereby assert that my participation is voluntary and that I knowingly assume all such risks.

Indemnification and Hold Harmless: I also agree to INDEMNIFY AND HOLD the Regents of the University of California HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney’s fees brought as a result of my involvement in Intramural Sports and to reimburse them for such expenses incurred.

Severability: The undersigned further expressly agrees that the foregoing waiver and assumption of risks agreement is intended to be as broad and inclusive as is permitted by law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Acknowledgement of Understanding: I have read this waiver of liability, assumption of risk, and indemnify agreement, fully understand its terms, and understand that I am giving up substantial rights, including my rights to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend by my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.

Intramural Sports Policies

1. I understand that all officiated team entry fees are $50 per team, all non-officiated team entry fees are $30 per team, and all individual/dual sport entry fees are $10 per team. I understand that all team sport fines are $20 and all individual/dual sport fines are $10.
2. As a student, I understand that all entry fees and/or fines imposed on my team will be charged to my student account.
3. As an IM card holder, I understand that all entry fees and fines will be will be due by the date set by the Intramural Sports office. Failure to pay my entry fee(s) or fine(s) on time will result in my immediate and indefinite suspension from all Intramural activity until it is paid. All payments are processed at the ARC Business Center Monday through Friday between the hours of 11 a.m. to 8 p.m.
4. I understand that Undergraduate, Graduate, and Professional Students who have paid student fees for the current term are eligible to participate in the Intramural Sports Program.
5. I understand that alumni, students on PELP (Planned Educational Leave Program), faculty/staff, IEPP (International English and Professional Programs), spouse/domestic partner/dependent of UCD faculty/staff/student/alumni, credential students, visiting scholars, Sac City College Davis Center students, or graduate students on filing fee status are eligible to participate in the Intramural Sports Program ONLY if they purchase a current 2012-2013 IM Card.
6. I understand that to verify eligibility, the appropriate identification card must be presented prior to each contest in order to participate.
7. I understand that it is my responsibility, as team captain, for ensuring the eligibility of my team members, as well as informing the players on my team of the intramural policies, procedures, and eligibility rules.
8. I understand that a forfeit constitutes: 1) non-appearance, 2) less than the minimum required number of players on the field/court at game time, 3) late appearance (5 minutes after scheduled game time), 4) use of an ineligible player, or 5) cancellation of contest with less than 24 BUSINESS hours notice.
9. I understand that Intramural participation is restricted to ONE Men’s or Women’s team and ONE CoRec/Mixed team in each sport.
10. I understand that Email communication is used extensively concerning my team’s participation and that I will be held responsible for all information regarding my team that is distributed via email from the Intramural Sports Office.

I understand the above policies and rules. Should anyone on my team (including myself) fail to comply with the above policies, I as the team captain, agree to accept the consequences imposed by the Intramural Sports Office.
